How We Use Your Information

The information you provide to us when communicating in writing, online or by phone is not sold or shared with anyone at anytime. POND PRO 2000 may extend offers to you directly to you via e-mail or direct mail at which time our customers have the option of responding but in no way are these offers coming directly from our third party affiliates. Access to your information is restricted to POND PRO 2000. We do not disclose or sell your information to non-affiliated third parties, except with your prior consent. Currently, we do not use cookies to gather information about our customers.

Payment/Return Policy

A service charge of 2.5% per month will be charged on all invoices not paid within 15 days from the date of the invoice. Deposits on orders of 100 gallons or more are non-refundable. Clients agree to pay reasonable attorney fees and collection costs incurred by POND PRO 2000 and also gives their personal guarantee to any outstanding payments. Returns are not accepted 10 days after receipt. Warranties are based on the material being applied on the approved substrates as outlined on our website. Warranties are not provided for application on top of other applied materials. Using 3rd party materials under or on top of liquid PondPro 2000 voids warranty.

On our order form we ask that you confirm your order before submission and verify the information you completed. Please be sure your order is correct before submitting. POND PRO 2000 is not responsible for errors make by its customers. POND PRO 2000 retains all order forms processed over its website and sends out a response confirming the information you entered in your order form. We gladly replace any items you receive damaged by the carrier. It is the consumers responsibility to check the order before shipping company leaves. Should you not want FedEx or UPS to leave your order at the door if you are not at home you must contact us prior to your packing shipping. We are not responsible for lost orders that are left at your delivered location. After shipping company leaves you have accepted the order and verified that it was not damaged as it cannot be returned. POND PRO 2000 will provide a replacement on any damaged materials. For returns you need to contact the office and request a Return Material Authorization (RMA) form. We are not able to verify any returns without the required RMA being attached to the outside of the box. In the event you attempt to return a product without an RMA we are not responsible as there is no way to track it back to your respective order. Any returns will be charged a restocking fee and re-boxing fee plus the original cost to ship to you location. We will gladly return any product within 7 days of your receipt.

WARRANTY INFORMATION

This product is guaranteed to be free of manufacturer defects. PondPro will replace any portion which is deemed manufactured incorrectly. Product must be returned to us for evaluation in its original container. This guarantee does not include labor or cost of labor for the application of any coating. Tinted coatings, special order items are not returnable. No returns are allowed 7 days after receipt.

EPDM Coating, warrants PondPro2000® and PondPro Concrete for a period of 5 years when the following conditions are met:

• Mixing of product was performed according to directions on label allowing for equitable distributor of product.
• PondPro2000® and PondPro Concrete was applied to a sound surface according to application instructions and resulted in a dry film thickness of approximately 30 mils.
• Failure was not caused by accident, fire, hurricane, tornado, or deterioration of the original construction materials.
• PondPro2000® and PondPro Concrete was not applied over an asphalt coating or silicone caulk or 3rd party coating and was used on only approved substrates.
• Customer will need to provide original proof of purchase (original receipt) not credit card receipt to establish an approximate date of use.
• Customer submits a sample of the failed membrane and a description of the construction (i.e. metal, fiberglass, rubber, etc.) when making a warranty claim.

The membrane is deemed to have failed if it loses adhesion, cracks, erodes, or otherwise fails to provide an effective weather barrier for the substrate to which it was applied. The substrate must remain in a sound and stable condition.

This warranty is in place of any implied warranty of merchantability and all other warranties expressed or implied. This warranty is limited to the replacement of material only.

Pond pro 2000 LLC, The manufacturer, will, at the customer's option, either replace the quantity of material originally used or supply a sufficient amount to complete the repair of the damage, freight prepaid, when the above conditions are met and failure occurs any time within a 5 year period from the time of application.

Since the manner and condition of application are beyond our control, neither seller nor manufacturer shall be liable for any injury, loss or damage, direct or consequential arising out of the use or the inability to use this product. The buyer's sole and exclusive remedy against the manufacturer or his agent shall be the replacement of the defective product, and no other remedy (including, but not limited to, incidental or consequential damages for lost profits, lost sales, injury to property, labor costs and expenses or any other incidental or consequential loss) shall be available to the buyer.
